Metzgar Inheritance Tax Reform Legislation Sent to Senate

Measure passes the House for the second consecutive session

HARRISBURG – House Bill 659, which seeks to eliminate the inheritance tax on property passing from a natural parent, adoptive parent or step-parent to or for the use of a child under 21 years of age or younger, was passed for the second consecutive session, said author Rep. Carl Walker Metzgar (R-Somerset/Bedford) today.

“This bill had a unanimous vote in the 2011-12 House session and now has passed for the second time in an effort to eliminate the levy commonly referred to as the ‘death tax’ on property that is legitimately passing to or for the use of a child under 21,” said Metzgar.

House Bill 659 would eliminate the current 4.5 percent tax placed on a property transfer of that type. Metzgar said it is one step in dealing with the overall issue of the “death tax.”

“It is sad, really, that people pay taxes on property all of their lives and end up being hit again for an additional tax upon the death of a family member, which to me, has always been unconscionable,” said Metzgar. “It is certainly even more hideous when you talk about property to be used for an underage child. There is no reason why this should not receive swift consideration.”

The bill, which passed as House Bill 1780 in the 2011-12 session, returns to the Senate for its consideration.
