Metzgar Legislation Helps Crime Victims Receive Restitution Payments

Legislation contained in House Bill 2686 which passed the House with a unanimous vote  recently, helps crime victims receive restitution without repeated court visits, said the bill’s prime sponsor, Rep. Carl Walker Metzgar (R-Somerset) today. 

“This bill, if enacted into law will help crime victims get the restitution they deserve through a process that would make it easier to collect it from persons convicted of the crime,” said Metzgar. “In too many cases, these victims are, in essence, re-victimized as those who owe restitution try to get away without paying it. I am hopeful that the Senate and governor see that crime victims deserve compassion and our best efforts to get the money that has been rightfully awarded to them by the courts.” 

The legislation extends the time period in which a collection agency has to collect restitution, fines and court costs from 180 days to 48 months. Under current law, when the 180-day period would elapse without proper payment, the court would have to reauthorize the collection, which often does not happen. 

“Crime victims have been through enough with the trauma of the crime itself,” said Metzgar. “It is unfair that they have to go back through a bureaucratic process just to receive what they have been awarded in the first place. The extension of the time period should alleviate that. I am grateful to my House colleagues for their unanimous support”
